Seasoned & Dressed Terms & Conditions

RULES FOR ORDERING

1. We prefer to have orders through online ordering for quicker processing and keeping records (emails also accepted).

2. Ideally please provide 30 hours notice for your orders, in this way we can organise purchasing and production of the freshest produce. We are aware that last minute meetings are “sent as a trial” and we will endeavour to assist – but please be aware that “last minute” requests for the same day will incur a $40.00+GST emergency “call out” fee if we can meet your order at such short notice.

3. Please let us know when placing your order if it is to be paid for by a different company, so they can be invoiced.

4. Any orders for next day placed after 1pm will be Chef’s Choice

5. Minimum orders;

Morning / Afternoon Teas – minimum order of $50.00+GST – all Afternoon Teas under $100.00+GST will be cold items catered only.

Lunches – minimum order of $100.00+GST

Weekends – minimum order of $450.00+GST per weekend day

STAFF CHARGES

Chefs – minimum 3 hours @ $30.00+GST p/h

Waiters – minimum 3 hours @ $25.00+GST p/h

Bar Manager / GM licence holder – minimum 3 hours @ $30.00+GST per hour

RIGHTS

1. Seasoned & Dressed reserves the right to refuse any order or membership of a potential
customer and payment for any reason whatsoever.

2. Seasoned & Dressed reserves the right to change the pricing throughout the whole period of this menu agreement. Notification of any price changes will be no less than 10 days.

3. Seasoned & Dressed reserves the right to make amends and repay any amounts incorrectly charged to your credit/debit card by either refunding the credit/debit card used or depositing to the nominated bank account.

4. Seasoned & Dressed reserves the right to change the menu at any time.

5. Seasoned & Dressed reserves the right to make changes, inclusions and/or improvements to these Terms and Conditions at any time including meeting regulatory and legal requirements as well as correcting errors. Even if one or more clauses are found to be unenforceable or invalid, the remaining conditions shall not be affected.

6. Seasoned & Dressed’s failure to enforce strict compliance with these terms and conditions will not constitute a waiver of any of their rights.

RESPONSIBILITY OF CUSTOMER

1. It is the responsibility of the Customer to protect their login details and keep their information
safe as every order made under their login, they will be liable for.

PAYMENT

1. All prices are in NZ dollars and exclusive of GST and delivery.

2. You will receive an invoice/receipt of your order via email.

3. Payment of online orders for Seasoned & Dressed Catering will be via Payment Express Gateway and your credit/debit card will be deducted the due amount immediately following your order. If your credit/debit card is declined for your first order and payment cannot be taken, then no order will be processed or delivery made.

4. Payment by debit/ credit card will not apply if your company has applied and been accepted to order on invoice.

5. Most major credit/debit card are accepted (excluding Diners Club Cards).

MEAL PRODUCTION / AVAILABILITY AND QUALITY

Seasoned & Dressed makes every effort to fulfil all orders from the menu and website, but accepts no responsibility if due to lack of availability, we are unable to source particular product(s). In the unlikely event that certain products may not be available, we will make every effort to replace with a similar item. If we are unable to fulfil a particular order due to limits of product availability, we will inform you via email and adjust your charge accordingly.

In the event that a product is delivered which is deemed to be substandard, Seasoned & Dressed will require photographic evidence and/or a sample in order to assess and consider crediting the value of the damaged product.

Seasoned & Dressed adheres to all food and health safety regulations. Once delivered, Seasoned & Dressed can accept no responsibility for any negligence or use that is not suitable and with regard to refrigeration or heating of foodstuffs. We request that all food delivered be consumed within two hours.

Please ensure all plates / platters are rinsed and ensure that they are ready for pick up the following day.

We can deliver hot food at no further charge; however, deliveries after 2.00pm which include hot food items will incur a further $10.00+GST charge

Any breakages or losses will be on-charged.

All food that has been delivered must be consumed within two hours – Seasoned & Dressed accepts NO responsibility for food that has been delivered and left out. All food delivered cold must be stored in refrigerated conditions until consumed.

SPECIAL DIETARY INFORMATION:

Please note that all customer chosen special diets for less than 6 people of any item will incur a Surcharge of $2.00+GST per item.

Special Diets = Dairy Free, Gluten Free, VEGAN & any other special requirement or request.

Seasoned & Dressed cannot guarantee that all items will be gluten or nut/allergy free due to our kitchens preparing a wide range of products.

Seasoned & Dressed therefore accepts no responsibility should you become affected by any allergens. The customer must be responsible for checking all items delivered.

DELIVERY AREAS:

CBD daily delivery fee is $6.00 (includes delivery and pick-up of plates and equipment) Please enquire about deliveries outside the CBDThere will be a $12 delivery fee for orders delivered under $100 (plus gst), Our delivery area is limited to the urban areas of the Greater Wellington Region.

DELIVERY CONDITIONS:

1. Delivery will be made to the delivery point as instructed and loaded on the customers
account.

2. Any occupant receiving the catering at the intended address, Seasoned & Dressed will assume is either the customer or someone who has been authorised to receive the delivery.

3. You are required to ensure the safe passage and accessibility of delivery onto your premise. If a Delivery Driver feels unsafe or threatened in any way to enter your premise, then you will be notified to make alternate arrangements as agreed and suitable to Seasoned & Dressed. Where it is safe to deliver, or there is no one to receive the catering then it will be left at a designated area that you have specified and deemed to be delivered. You will be contacted via phone and email should there be any issue with your delivery.

4. If you receive an incorrect catering delivery, then please notify us immediately, then we will gladly replace and deliver your correct catering. Seasoned & Dressed reserve the right to retrieve the incorrect catering in the state to which it was
distributed and delivered to you. Should any contents of the catering be damaged or taken, Seasoned & Dressed may on charge and recover costs for the loss.

5. Delays in your delivery can happen from time to time due to unforeseen circumstances. In this case, Seasoned & Dressed will make contact with you to determine an alternative time frame to which it would be suitable to deliver your catering.

6. Ownership, risk and responsibility of the catering shall be passed to the Customer upon delivery.

COPYRIGHT AND OTHER INTELLECTUAL PROPERTY OWNED BY SEASONED &
DRESSED:

Intellectual Property includes but is not limited to: trademarks, designs, concepts, processes and systems, written copy & content, idea, information, data, photo’s and all other material related to the Website including recipes are owned by and remain the exclusive property of Seasoned & Dressed and its providers and is protected and interpreted in accordance with the laws of New Zealand.

FORCE MAJEURE

The customer understands and agrees that in the event of a “force majeure” which includes: natural disaster, premise fire, flood, casualty, act of God, accident, any law, rule and regulation, order, demand or requirement of any government and/or agency, strikes, union and labour disputes, transportation delays, gas/electricity failure, telecommunications & network failures, or any other major events beyond control of Seasoned & Dressed which makes it unable to carry out any tasks associated with supply and performance, Seasoned & Dressed shall be excused of its obligations under these terms and conditions.

WEBSITE AND PERSONAL INFORMATION/PRIVACY:

WHAT DO WE DO WITH YOUR INFORMATION?

When you purchase something from our store, as part of the buying and selling process, we collect the personal information you give us such as your name, address, phone number and email address.

When you browse our store, we also automatically receive your computer’s internet protocol (IP) address in order to provide us with information that helps us learn about your browser and operating system.

Email marketing: With your permission, we may send you emails about our store, new products and other updates.

When you provide us with personal information to complete a transaction, verify your credit/debit card, place an order, arrange for a delivery or return a purchase, we imply that your consent to our collecting it and using it for that specific reason only. WOOCOMMERCE

Our store is hosted on Woocommerce Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you. Your data is stored through Woocommerce’s data storage, databases and the general Woocommerce application. We store your data on a secure server behind a firewall. Payment: If you choose a direct payment gateway to complete your purchase, then Payment Express stores your credit/debit card data. It is encrypted through the Payment Card Industry Data Security Standard (PCI-DSS). Your purchase transaction data is stored only as long as is necessary to complete your purchase transaction. After that is complete, your purchase transaction information is deleted.

All direct payment gateways adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover. PCI-DSS requirements help ensure the secure handling of credit/debit card information by our store and its service providers.
